Terms and Conditions

These terms apply to every service bought from Dani Digital Limited, a company registered in England and Wales (number 13812823), run by Danielle Theobald ("Dani Digital", "I", "me", "my"). By paying an invoice, paying by card, or confirming a proposal in writing, you ("you", "the client") accept these terms.

1. Who I am

2. Services

I provide marketing services for health and wellness brands. These include the Pinterest Foundation, Pinterest Engine and Pinterest Partner packages, agency management of Instagram and Pinterest, and Fractional CMO work.

What each package includes is shown on its page on this site, or in the written proposal I send you. If the proposal and the website differ, the proposal wins.

3. Starting work

A contract starts when you confirm the proposal in writing (email is fine) and pay the first invoice. I book your start date once payment clears.

You agree to give me the access, brand assets, approvals and information I need, on time. Delays on your side move delivery dates by the same amount of time.

4. Prices and payment

All prices are in pounds sterling (GBP). I am not VAT registered, so no VAT is added.

You can pay by bank transfer or by card. Card payments are processed by Wise. I never see or store your full card details.

Invoices are due within 7 days. If a payment is late, I may pause work until it is paid. Late business payments may carry statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

  • Pinterest Foundation (£1,200, one-time): paid in full before work starts, or 50% before work starts and 50% at handover if agreed in writing.
  • Pinterest Engine (£2,000 a month): billed monthly in advance, on the same date each month.
  • Pinterest Partner (£7,500, flat fee): paid in full before work starts. This fee is non-refundable in all circumstances.
  • Agency and Fractional CMO work: the monthly fee in your proposal, billed monthly in advance.

5. Minimum terms and ending a contract

Monthly services (Pinterest Engine, agency work) run month to month. Either side can end them with 28 days' written notice.

Fractional CMO work has a minimum term of 3 months. The notice period after that is set out in your signed contract.

6. Results

I use my experience and best efforts to grow your traffic, reach and revenue. Social platforms change their rules and algorithms without notice, so I cannot promise specific numbers, except where a package states a target in writing.

Pinterest Partner: I keep working until your account reaches 1 million monthly impressions, for as long as that takes. This depends on you keeping the account active and giving me the access and approvals I need.

7. Content and ownership

Once you have paid in full, you own the pins, captions, templates, keyword research and strategy documents I create for you.

I keep ownership of my own methods, processes and pre-existing materials. You may use them for your own brand, but not resell them.

You confirm that anything you give me to use (logos, photos, product claims) is yours to use, and that health claims about your products are accurate and legal. You are responsible for regulatory compliance of your product claims.

Unless you ask me not to, I may mention you as a client and share results (without confidential figures) in my portfolio.

8. Confidentiality

I keep your business information, figures and logins confidential, during and after our work together. This does not cover information that is already public.

9. Liability

My total liability under any contract is limited to the fees you paid me in the 3 months before the claim.

I am not liable for loss of profit, revenue or data, or for actions taken by social platforms (such as account suspensions or reach changes).

Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

11. Changes to these terms

I may update these terms. The version that applies to you is the one live when you confirmed your proposal, unless we agree otherwise in writing.

12. Law

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
